Welcome to Easy Rain LLC. These Terms and Conditions govern your use of our website, services, estimates, communications, appointments, proposals, contracts, installations, warranties, and related interactions with Easy Rain LLC.

By using our website, submitting a form, requesting an estimate, scheduling an appointment, responding to our advertising or marketing, communicating with us by phone, text, email, social media, messaging platform, or other channel, accepting a proposal, or purchasing services from Easy Rain LLC, you agree to these Terms and Conditions.

Please read these Terms carefully. If you do not agree with these Terms, you should not use our website, request services, schedule an appointment, approve a proposal, or otherwise engage Easy Rain LLC.

1. Company Information

These Terms apply to Easy Rain LLC, referred to in these Terms as “Easy Rain,” “we,” “us,” or “our.”

2. Use of Our Website

The Easy Rain website is provided for informational, scheduling, marketing, and customer-service purposes. You may use our website to learn about our services, request a quote, contact our team, view project information, review warranties, submit project details, and communicate with us.

You agree not to use our website for any unlawful, abusive, fraudulent, harmful, or disruptive purpose. You may not attempt to interfere with the website, bypass security measures, scrape content without permission, upload malicious code, impersonate another person, submit false information, or use the website in a way that could harm Easy Rain, our customers, our vendors, or our systems.

We may update, modify, suspend, or discontinue any part of the website at any time without notice.

3. No Guarantee of Website Accuracy

We work to keep the information on our website accurate and helpful. However, website content is general in nature and may not apply to every property, project, material, roofline, gutter system, drainage issue, building condition, or service scenario.

Website content, photos, blog posts, pricing information, promotions, descriptions, diagrams, FAQs, and other materials are provided for general informational purposes only. They are not a final quote, construction plan, engineering opinion, legal opinion, warranty promise, or guarantee of project outcome.

Final pricing, scope, timeline, service details, warranty coverage, and project recommendations must be confirmed in writing by Easy Rain.

4. Estimates, Inspections, and Appointments

You may request an estimate or appointment through our website, by phone, by text, by email, by social media, through paid advertising, through referrals, or through other communication platforms.

By requesting an estimate, scheduling an appointment, responding to our marketing, or otherwise asking Easy Rain to contact you, you agree that Easy Rain may contact you regarding your inquiry, appointment, estimate, project, property, service options, scheduling, financing options, promotions, follow-up questions, reminders, and related services.

Estimates are based on the information available at the time of inspection, measurement, conversation, or proposal preparation. Estimates may be revised if additional information becomes available, including but not limited to hidden damage, inaccurate measurements, access limitations, roofline complexity, fascia or soffit damage, drainage issues, rot, pest damage, structural problems, material availability, code requirements, weather constraints, customer-requested changes, or other unforeseen conditions.

Easy Rain reserves the right to decline, revise, or withdraw an estimate at any time before a formal agreement is accepted.

5. Free Quotes and Promotional Offers

Easy Rain may offer free quotes, discounts, seasonal promotions, financing promotions, referral offers, or other special pricing at our discretion.

Promotions may be limited by date, service type, project minimum, geographic area, availability, approved credit, qualifying scope of work, or other conditions. Unless clearly stated otherwise in writing, promotions cannot be combined with other offers, applied retroactively, transferred, redeemed for cash, or used on previously approved projects.

Easy Rain may modify, extend, limit, or end any promotional offer at any time.

6. Communication Consent

Easy Rain communicates with customers and prospective customers through multiple channels, including but not limited to phone calls, text messages, emails, website forms, social media messages, direct messages, voicemail, online scheduling tools, review platforms, advertising platforms, and other communication methods.

By submitting your contact information, requesting an estimate, scheduling an appointment, responding to our marketing, asking for project information, replying to one of our messages, calling us, texting us, emailing us, or otherwise engaging with Easy Rain, you authorize Easy Rain to contact you using the contact information you provide or use to communicate with us.

This communication may include, but is not limited to:

  • Appointment scheduling
  • Appointment reminders
  • Estimate confirmations
  • Project updates
  • Proposal follow-ups
  • Service reminders
  • Warranty or service-related communication
  • Payment reminders
  • Customer support
  • Review requests
  • Promotions or special offers
  • Marketing messages related to Easy Rain services
  • Messages through platforms where you contacted or interacted with Easy Rain

You understand that communication may occur by phone call, text message, email, voicemail, social media message, direct message, or other platform-based messaging.

You represent that any phone number, email address, property address, or account information you provide belongs to you or that you have permission to provide it to Easy Rain.

7. Text Message and Phone Call Terms

By providing your phone number to Easy Rain, requesting an estimate, scheduling an appointment, responding to our marketing, texting us, calling us, submitting a website form, or otherwise communicating with us, you consent to receive phone calls and text messages from Easy Rain related to your inquiry, appointment, estimate, service, project, account, promotional offers, or other Easy Rain services, to the fullest extent permitted by law.

Message frequency may vary. Standard message and data rates may apply. Easy Rain is not responsible for any charges imposed by your mobile carrier.

You may opt out of text messages at any time by replying STOP, CANCEL, UNSUBSCRIBE, QUIT, END, or by otherwise clearly communicating that you no longer wish to receive text messages from Easy Rain. You may also contact us at 801-971-9846 or info@myeasyrain.com to request removal from future marketing communications.

After you opt out, we may still send limited non-marketing messages where legally permitted, such as communications necessary to complete a transaction, respond to your request, provide safety-related information, confirm your opt-out request, or address an active project, warranty issue, payment matter, or service obligation.

Consent to receive marketing communications is not required as a condition of purchasing any goods or services from Easy Rain.

8. Communication Through Third-Party Platforms

Easy Rain may communicate with you through third-party platforms, including but not limited to Facebook, Instagram, Google, Yelp, Thumbtack, Angi, HomeAdvisor, Nextdoor, email providers, SMS platforms, scheduling software, payment processors, CRM systems, review platforms, and other communication tools.

If you contact Easy Rain through a third-party platform, respond to our advertisement, submit a lead form, request a quote, comment on our content, message our page, or otherwise interact with us through that platform, you authorize Easy Rain to respond and communicate with you through that same platform or through the contact information you provide.

Third-party platforms may have their own terms, privacy policies, messaging rules, opt-out settings, data practices, and notification controls. Easy Rain is not responsible for the practices, errors, outages, policies, or conduct of third-party platforms.

9. Customer Information and Privacy

Your use of our website and services is also governed by our Privacy Policy. Our Privacy Policy explains what information we collect, how we use it, how we protect it, and how you may contact us regarding privacy-related requests.

By using our website, submitting information, requesting services, or communicating with Easy Rain, you acknowledge and agree that we may collect and use your information as described in our Privacy Policy.

10. Customer Responsibilities

You agree to provide accurate, complete, and current information when requesting an estimate, scheduling an appointment, approving a project, or communicating with Easy Rain.

You are responsible for:

  • Providing accurate contact information
  • Providing accurate property information
  • Confirming that you have authority to request work at the property
  • Notifying Easy Rain of access issues, pets, tenants, gates, locked areas, parking restrictions, HOA requirements, utility concerns, hazards, or property-specific limitations
  • Reviewing the estimate, scope of work, product selections, colors, materials, warranties, payment terms, and project details before approval
  • Obtaining HOA approvals, landlord approvals, property-owner approvals, or other permissions unless Easy Rain agrees in writing to assist
  • Ensuring safe and reasonable access to the work area
  • Removing vehicles, furniture, decorations, personal property, fragile items, or obstructions from the work area when requested
  • Notifying Easy Rain of known leaks, electrical hazards, roof problems, foundation issues, previous repairs, drainage problems, rot, mold, pests, or other relevant conditions

Easy Rain is not responsible for delays, added costs, access limitations, damages, or project complications caused by inaccurate information, lack of access, undisclosed conditions, unsafe conditions, customer delays, third-party approvals, or property conditions outside our control.

11. Property Access and Site Conditions

By approving a project or scheduling work, you authorize Easy Rain and its employees, subcontractors, representatives, vendors, or installers to access the property as reasonably necessary to inspect, measure, deliver materials, perform work, document work, collect payment, complete warranty service, or address project-related issues.

You agree to provide reasonable and safe access to the work area. This may include access to driveways, yards, gates, exterior walls, rooflines, fascia, soffit, gutters, downspouts, drainage areas, electrical outlets, water sources, or other relevant areas.

Easy Rain may decline to perform work or may pause work if we determine that conditions are unsafe, inaccessible, unsuitable, outside the agreed scope, or materially different from what was represented at the time of estimate.

12. Scope of Work

The scope of work for any project will be defined by the written estimate, proposal, invoice, contract, change order, or other written project documentation provided by Easy Rain.

Only items specifically included in the written scope are included in the project. Any item not expressly listed may be excluded, even if discussed verbally.

Examples of items that may require separate written approval or additional charges include:

  • Fascia replacement
  • Soffit replacement
  • Rot repair
  • Structural repair
  • Roof repair
  • Stucco repair
  • Siding repair
  • Paint touch-up
  • Electrical work
  • Underground drainage
  • Concrete work
  • Landscaping repair
  • Pest remediation
  • Mold remediation
  • Deck, patio, or awning modifications
  • Removal or replacement of unusual materials
  • Specialty colors or custom materials
  • Additional downspouts
  • Additional gutter guards
  • Rain chains, rain barrels, or specialty drainage components
  • Rework caused by customer-requested changes
  • Code upgrades or municipal requirements not included in the original scope

Verbal conversations, sales discussions, recommendations, or general explanations do not modify the written scope unless confirmed in writing by Easy Rain.

13. Change Orders and Additional Work

If additional work is requested, required, discovered, or recommended after the original estimate or agreement, Easy Rain may provide a change order, revised estimate, updated invoice, or written approval request.

Additional work may result in additional charges, revised timelines, material changes, or schedule adjustments.

Easy Rain is not required to perform work outside the agreed scope unless both parties approve the additional work in writing or unless Easy Rain determines that immediate action is reasonably necessary to protect the property, prevent damage, address safety concerns, or complete the project in a workmanlike manner.

14. Unforeseen Conditions

Exterior improvement projects may reveal hidden or unforeseen conditions that are not visible during the initial estimate. These may include but are not limited to:

  • Rotten fascia
  • Damaged soffit
  • Water intrusion
  • Mold or mildew
  • Pest damage
  • Improper prior installation
  • Structural movement
  • Inadequate roof edge conditions
  • Hidden electrical hazards
  • Damaged siding or stucco
  • Foundation drainage problems
  • Ice dam damage
  • Improper slope
  • Drainage blockages
  • Existing code violations
  • Weak attachment points
  • Deteriorated wood or substrate
  • Previous repairs hidden by paint, caulk, trim, or coverings

If unforeseen conditions are discovered, Easy Rain may recommend or require additional work before completing the original scope. Additional charges may apply.

Easy Rain is not responsible for pre-existing conditions, hidden damage, code violations, improper prior work, manufacturer defects, structural issues, or problems unrelated to our workmanship.

15. Materials, Colors, and Product Availability

Easy Rain may recommend or install materials including gutters, downspouts, gutter guards, soffit, fascia, fasteners, sealants, outlets, elbows, hangers, flashing, drainage components, and related products.

Material colors, finishes, textures, and appearances may vary due to manufacturing differences, lighting, weathering, age of existing materials, screen display differences, supplier availability, and batch variation.

Customer is responsible for reviewing and approving colors, materials, and product selections before installation. Easy Rain is not responsible for minor color variation, reasonable material variation, or differences between samples, photos, screens, and installed products.

If a selected material, color, profile, or product becomes unavailable, Easy Rain may recommend a substitute. Substitutions may require customer approval and may affect price or timeline.

16. Existing Structures and Attachment Points

Gutters, fascia, soffit, downspouts, and related exterior products depend on the condition of the existing structure. Easy Rain is not responsible for failures caused by weak, rotten, deteriorated, improperly built, improperly maintained, or structurally deficient attachment points.

If the existing fascia, soffit, roof edge, siding, stucco, brick, stone, trim, framing, or other surface is not suitable for proper attachment, Easy Rain may recommend repair or replacement before installation. If the customer declines recommended repairs, Easy Rain may limit or deny warranty coverage related to the affected area.

17. Drainage and Water Management

Easy Rain provides gutter and rainwater-management services designed to help collect, redirect, and manage water. However, no gutter, downspout, drainage, or exterior system can guarantee complete prevention of water intrusion, flooding, foundation movement, soil saturation, erosion, ice dams, roof leaks, basement leaks, or water damage under all conditions.

Drainage performance may be affected by:

  • Roof design
  • Roof pitch
  • Valley volume
  • Storm intensity
  • Snow and ice
  • Debris buildup
  • Soil conditions
  • Grading
  • Landscaping
  • Underground drain condition
  • Downspout placement
  • Existing foundation conditions
  • Existing waterproofing
  • Neighboring properties
  • Irrigation systems
  • Clogged drains
  • Improper maintenance
  • Unusual weather events

Unless specifically stated in writing, Easy Rain does not provide engineering services, foundation repair, waterproofing, landscaping, grading, hydrology analysis, or guaranteed water-intrusion prevention. 

Easy Rain gutter systems are designed to manage ordinary rainwater runoff from the roofline under normal operating conditions. Customer understands that gutters and downspouts are only one part of a property’s overall water-management system.

Easy Rain does not guarantee that gutters, downspouts, gutter protection, underground drains, rain barrels, tanks, heat cables, or related systems will prevent all overflow, flooding, water intrusion, soil saturation, erosion, foundation movement, basement leakage, ice dams, or moisture problems.

Roof defects, roof design, poor insulation, lack of ice shield, grading, soil conditions, underground drainage, landscaping, snow, ice, clogged drains, foundation conditions, and other property factors may affect performance.




18. Maintenance Responsibilities

Gutter systems, downspouts, gutter guards, drains, and exterior systems require maintenance. Customer is responsible for routine inspection, cleaning, and maintenance after installation unless a separate maintenance agreement is in place.

Maintenance may include:

  • Clearing debris from gutters
  • Checking downspouts
  • Cleaning gutter guards
  • Flushing underground drains
  • Removing roof debris
  • Monitoring snow and ice buildup
  • Checking for loose fasteners
  • Inspecting sealant
  • Keeping landscaping from blocking drainage
  • Watching for signs of overflow, staining, erosion, or leakage

Failure to maintain the system may void or limit warranty coverage.

Customer understands that even products advertised as low-maintenance, clog-resistant, or gutter-protection systems may still require reasonable care, inspection, and occasional maintenance. “Lifetime service warranty,” “no-clog warranty,” or similar language does not eliminate customer’s responsibility to monitor the system, report issues promptly, prevent avoidable damage, and maintain related property conditions.

Customer is responsible for maintaining roof surfaces, trees, landscaping, underground drains, fascia, soffit, siding, electrical systems, rain barrels, tanks, filters, heat cable power sources, and other related property components unless Easy Rain has expressly agreed in writing to maintain those items.

19. Scheduling and Delays

Easy Rain works to schedule projects efficiently and professionally. However, scheduling is subject to weather, material availability, labor availability, customer readiness, property access, supplier delays, permitting, safety conditions, and other factors.

Project dates and installation windows are estimates unless expressly stated in writing as guaranteed. Easy Rain is not responsible for delays caused by weather, supply chain issues, unsafe conditions, customer delays, change orders, unforeseen conditions, third-party delays, acts of God, emergencies, or circumstances outside our reasonable control.

20. Payment Terms

Payment terms will be stated in the estimate, proposal, invoice, contract, financing agreement, or other written project document.

Unless otherwise stated in writing, payment is due according to the agreed project terms. Easy Rain may require a deposit, progress payment, final payment upon completion, payment before ordering custom materials, or other payment structure.

Customer agrees to pay all amounts owed for approved work, materials, change orders, and additional services.

Easy Rain may pause work, delay scheduling, withhold warranty service, charge late fees where permitted, pursue collection, or exercise any legal rights available if payment is not made as agreed.

Customer is responsible for any returned payment fees, collection costs, attorney fees, filing fees, lien-related costs, or other costs incurred by Easy Rain in collecting unpaid amounts, to the fullest extent permitted by law.

21. Financing

Easy Rain may offer or help facilitate financing options through third-party financing providers. Financing approval, terms, rates, promotional periods, payment amounts, credit limits, and eligibility are determined by the financing provider, not Easy Rain.

Any financing agreement is between the customer and the financing provider. Easy Rain is not responsible for credit decisions, financing denials, interest charges, late fees, credit reporting, promotional financing requirements, or changes to financing terms.

Customer is responsible for reviewing and understanding all financing terms before signing or accepting financing.

22. Cancellations and Rescheduling

Customers should notify Easy Rain as soon as possible if they need to cancel or reschedule an appointment or project.

Easy Rain may reschedule appointments or work due to weather, safety concerns, labor availability, material delays, emergency work, customer access issues, or other reasonable business needs.

If a customer cancels a project after materials have been ordered, custom work has begun, scheduling resources have been reserved, or labor has been allocated, the customer may be responsible for costs already incurred, including custom materials, restocking fees, administrative costs, design time, permit fees, supplier charges, and other expenses.

Cancellation terms may be further defined in the written proposal, contract, invoice, or financing documents.

23. Customer Approval

By accepting a proposal, signing a contract, approving an estimate, paying a deposit, authorizing work by text, email, phone, electronic signature, financing approval, or other written or electronic method, customer authorizes Easy Rain to proceed with the agreed work.

Electronic approvals, text approvals, email approvals, and digital signatures may be treated as valid authorization.

24. Photos, Videos, and Project Documentation

Easy Rain may take photos, videos, measurements, notes, or other documentation of the property, work area, installation process, completed work, and project conditions for purposes including estimating, quality control, training, warranty review, customer communication, internal records, insurance, dispute resolution, marketing, and portfolio use.

Easy Rain may use non-sensitive project photos or videos for marketing, website content, social media, advertising, training, or educational purposes unless the customer requests otherwise in writing. Easy Rain will not intentionally publish private personal information such as full names, personal contact information, or sensitive interior details without permission.

If you do not want Easy Rain to use project photos or videos for marketing purposes, please notify us in writing before the project begins.

25. Reviews, Testimonials, and Feedback

If you submit a review, testimonial, comment, message, photo, or feedback about Easy Rain, you grant Easy Rain permission to use, reproduce, publish, display, and share that feedback for marketing, training, reputation management, and business purposes.

Easy Rain may edit testimonials for length, grammar, formatting, or clarity, but will not intentionally change the substance of your statement.

26. Warranties

Easy Rain may provide workmanship warranties, service warranties, product warranties, manufacturer warranties, lifetime service warranties, gutter protection warranties, rainwater system warranties, heat cable warranties, or other warranties depending on the specific products and services purchased.

Warranty coverage is determined by the written estimate, proposal, invoice, contract, warranty page, manufacturer documentation, and any written warranty terms provided by Easy Rain.

Easy Rain’s current warranty structure may include, but is not limited to, the following:

26.1 Lifetime Service Warranty

All qualifying Easy Rain systems may be eligible for Easy Rain’s lifetime service warranty. The lifetime service warranty means Easy Rain will make a good-faith effort to review and help address service issues related to an Easy Rain system for as long as the warranty remains valid, the property remains standing, and Easy Rain remains in business.

The lifetime service warranty does not mean every repair, replacement, service visit, part, material, labor item, or issue will be free. Many minor service items may be handled at no charge, but some issues may require parts, labor, service charges, replacement costs, or full-price repairs depending on the cause of the issue.

Easy Rain reserves the right to determine, after review or inspection, whether a service issue is covered by warranty, partially covered, excluded, maintenance-related, caused by outside factors, or subject to additional charges.

Excessive service calls, unreasonable service requests, long-distance service calls, repeated non-warranty issues, or service requests outside normal warranty coverage may be subject to service charges. Service charges may vary depending on frequency, distance from Easy Rain’s office, labor required, materials required, access conditions, and other relevant factors.

26.2 Gutter Protection Warranty

Gutter protection products installed by Easy Rain may be guaranteed to help prevent interior and exterior clogging of the gutter system, subject to the limitations, exclusions, maintenance requirements, and service terms stated by Easy Rain.

If qualifying buildup occurs on top of the gutter guard from tree debris, roof debris, asphalt granules, or similar material, Easy Rain may arrange a service call to clean the affected area at no charge, provided the issue qualifies under the applicable warranty and is not excluded by these Terms or the written warranty.

This warranty does not cover damage, malfunction, or performance issues caused by abuse, impact, improper maintenance, extreme weather, ice, snow, animals, roof conditions, third-party work, structural issues, cosmetic damage, or other causes outside Easy Rain’s control.

26.3 Gutters and Downspouts Installed With Gutter Protection

When Easy Rain installs new gutters, new downspouts, and gutter protection together as part of the same qualifying system, the new gutters and downspouts may qualify for lifetime warranty coverage against leaking, clogging, and sagging, subject to the written warranty terms, exclusions, and Easy Rain’s inspection and determination.

This warranty is intended to cover qualifying workmanship or system-performance issues related to the Easy Rain-installed gutter system. It does not cover unrelated property conditions, roof problems, ice dams, structural movement, fascia failure, storm damage, impact damage, cosmetic damage after installation, customer modifications, third-party work, lack of maintenance, or other excluded causes.

This warranty may be transferable if allowed under the applicable written warranty.

26.4 Existing Gutters With Added Gutter Protection

If Easy Rain installs gutter protection on existing gutters and downspouts that are not replaced by Easy Rain at the same time, Easy Rain does not provide a warranty on the existing gutters, existing downspouts, existing slope, existing seams, existing fasteners, existing attachment points, existing materials, existing leaks, existing sagging, or other pre-existing conditions.

In that situation, the applicable warranty is limited to the gutter protection product and qualifying no-clog coverage, unless otherwise stated in writing.

If existing gutters later leak, sag, separate, overflow due to non-covered causes, or otherwise fail, Easy Rain may offer repair or replacement services at normal pricing. If Easy Rain replaces the affected gutter or downspout and reinstalls qualifying gutter protection, the new system may become eligible for the applicable full warranty terms.

26.5 Gutters and Downspouts Installed Without Gutter Protection

New gutters and downspouts installed by Easy Rain without gutter protection may carry a two-year workmanship warranty, unless otherwise stated in writing.

This warranty is intended to cover qualifying workmanship issues caused by Easy Rain’s installation. It does not cover clogs, debris buildup, ice, snow, storm damage, roof issues, fascia failure, lack of maintenance, animal damage, customer damage, third-party work, cosmetic damage after installation, or other outside causes.

26.6 Rain Barrels, Tanks, and Rain Collection Systems

Rain barrels, tanks, and rain collection components may be warrantied against qualifying manufacturer defects or Easy Rain workmanship issues, subject to inspection, maintenance requirements, product limitations, and applicable written warranty terms.

Customer is responsible for reasonable care, maintenance, cleaning, winterization where appropriate, protection from damage, and safe use of rain collection systems.

Warranty coverage may be denied or limited for issues caused by improper care, lack of maintenance, cosmetic damage, normal wear and tear, abuse, lawnmower damage, pets, children, freezing, impact, customer modifications, third-party damage, or other causes outside Easy Rain’s control.

26.7 Water Purification Systems

Water purification systems, filters, and related components may be covered by manufacturer warranties or Easy Rain workmanship warranties where applicable.

Customer is responsible for regular maintenance, filter replacement, water testing, proper use, and compliance with all manufacturer instructions.

Easy Rain does not guarantee that rainwater, collected water, filtered water, or purified water is safe to drink unless expressly stated in a separate written agreement. Customer is solely responsible for testing water before consumption and maintaining all components necessary for safe use.

26.8 Heat Cable Systems

Heat cable systems installed by Easy Rain may be warrantied against qualifying workmanship issues such as detachment or leaks caused by Easy Rain’s installation, subject to the written warranty terms and exclusions.

Heat cable products may have separate manufacturer or product-specific warranty terms.

Customer is responsible for ensuring that the property’s electrical system, outlets, breakers, panels, wiring, and related electrical components are suitable and safe for the electrical load required by the heat cable system. Easy Rain is not responsible for failures, tripped breakers, power loss, electrical damage, fire, injury, electrocution, or other issues caused by inadequate, unsafe, outdated, defective, or overloaded electrical systems.

Heat cable warranty coverage does not apply to damage caused by snow, ice, animals, other contractors, roof work, electrical problems, customer modifications, physical damage, or other causes outside Easy Rain’s control.

26.9 Manufacturer Warranties

Some materials or products installed by Easy Rain may be covered by manufacturer warranties. Manufacturer warranties are controlled by the manufacturer’s own terms, limitations, exclusions, registration requirements, transfer rules, and claim procedures.

Easy Rain does not control manufacturer warranty decisions and is not responsible for manufacturer denials, delays, discontinued products, replacement limitations, or warranty interpretations.

26.10 Warranty Exclusions

Unless expressly stated otherwise in writing, Easy Rain warranties do not cover:

  • Ice dams
  • Snow or ice buildup
  • Damage from extreme weather
  • Roof defects
  • Poor roof design
  • Lack of ice shield
  • Poor insulation
  • North-facing roof conditions
  • Shade-related ice issues
  • Water running behind gutters due to roof problems
  • Fascia failure
  • Soffit failure
  • Siding, stucco, brick, stone, or trim defects
  • Foundation issues
  • Structural movement
  • Pre-existing conditions
  • Hidden damage
  • Rot, mold, pests, or decay
  • Electrical deficiencies
  • Unsafe or inadequate electrical systems
  • Improper maintenance
  • Lack of cleaning
  • Debris buildup outside the stated warranty coverage
  • Underground drainage blockages unless expressly covered
  • Cosmetic damage after installation
  • Impact damage
  • Lawn equipment damage
  • Animal damage
  • Pet or child damage
  • Abuse, misuse, or neglect
  • Customer modifications
  • Third-party work
  • Damage caused by other contractors
  • Acts of God
  • Normal wear and tear
  • Product misuse
  • Failure to follow Easy Rain recommendations
  • Failure to approve recommended repairs
  • Conditions outside Easy Rain’s control

27. Warranty Claims and Service Requests

To submit a warranty claim or service request, customer must contact Easy Rain and provide reasonable information about the issue, including:

  • Customer name
  • Property address
  • Contact information
  • Original project details, if available
  • Description of the issue
  • Photos or videos, if available
  • Date the issue was first noticed
  • Any relevant maintenance history
  • Any work performed by others after Easy Rain’s installation

Easy Rain may require an inspection before determining whether a claim is covered by warranty.

If the issue is covered, Easy Rain will determine the appropriate remedy. If the issue is not covered, Easy Rain may offer repair, replacement, cleaning, adjustment, or other service at standard or quoted pricing.

Easy Rain is not required to provide free service for non-warranty issues, excessive service calls, issues caused by outside factors, issues caused by customer damage, issues caused by lack of maintenance, issues caused by other contractors, or issues outside the original scope of work.

Failure to promptly report an issue may limit warranty coverage if the delay causes additional damage or prevents Easy Rain from reasonably evaluating the issue.

28. Limitation of Liability

To the fullest extent permitted by law, Easy Rain is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of use, loss of value, lost profits, inconvenience, emotional distress, business interruption, or damage caused by conditions outside Easy Rain’s control.

Easy Rain’s total liability for any claim related to a project, service, estimate, communication, website use, or these Terms shall not exceed the amount paid by the customer to Easy Rain for the specific service giving rise to the claim, unless otherwise required by law.

Nothing in these Terms is intended to limit liability where such limitation is prohibited by law.

Easy Rain is not liable for damage, injury, loss, or expense caused by unsafe or inadequate existing electrical systems, customer use of collected rainwater, customer failure to test water before consumption, customer failure to maintain filtration systems, ice dams, poor roof conditions, structural defects, foundation issues, hidden property conditions, or other causes outside Easy Rain’s control.


29. Pre-Existing Damage and Related Property Conditions

Easy Rain is not responsible for pre-existing damage, hidden defects, improper prior work, faulty construction, roof defects, siding defects, stucco defects, foundation issues, drainage problems, rot, mold, pests, structural issues, code violations, or other conditions not caused by Easy Rain.

During installation or repair, existing materials may crack, break, shift, reveal damage, or require modification due to age, brittleness, improper prior installation, hidden deterioration, or site conditions. Easy Rain will take reasonable care, but is not responsible for unavoidable damage to deteriorated, defective, or improperly installed existing materials.

30. Third-Party Services and Subcontractors

Easy Rain may use subcontractors, vendors, suppliers, software providers, financing providers, payment processors, advertising platforms, scheduling tools, communication platforms, or other third parties to support our business and services.

Easy Rain is not responsible for the independent acts, omissions, policies, delays, errors, outages, financing decisions, data practices, or warranty decisions of third parties except where required by law or expressly agreed in writing.

31. Permits, Codes, HOAs, and Approvals

Customer is responsible for notifying Easy Rain of any HOA requirements, landlord requirements, property management rules, architectural guidelines, neighborhood restrictions, municipal requirements, or other approval obligations related to the project.

Unless expressly stated in writing, customer is responsible for obtaining HOA approvals, landlord approvals, architectural approvals, and other non-permit permissions.

Permit responsibility, if applicable, will be determined by the written scope of work and applicable law. Easy Rain may assist with permits when required and agreed in writing. Permit fees, engineering fees, plan review fees, inspection fees, and related costs may be additional unless included in the written proposal.

32. Commercial Projects

Commercial projects may involve additional requirements, including insurance documentation, site safety rules, project management coordination, tenant access, property manager approvals, payment schedules, prevailing wage requirements, certificates of insurance, compliance documents, warranties, and other commercial terms.

Commercial project terms may be supplemented or modified by a separate written agreement, bid package, purchase order, subcontract, or commercial proposal.

If a commercial agreement conflicts with these Terms, the signed commercial agreement controls for that project.

33. Safety

Customer agrees to maintain a safe work environment and disclose known hazards before work begins.

Hazards may include but are not limited to:

  • Electrical hazards
  • Unsafe roof conditions
  • Loose siding or fascia
  • Structural instability
  • Aggressive animals
  • Hazardous materials
  • Unsafe access
  • Tenant conflict
  • Biohazards
  • Unstable soil
  • Hidden utilities
  • Dangerous weather conditions
  • Ice, snow, or slippery surfaces

Easy Rain may refuse, pause, or reschedule work if conditions are unsafe.

34. Pets, Children, and Occupants

Customer is responsible for keeping pets, children, tenants, guests, and occupants away from work areas during inspection, delivery, installation, repair, or cleanup.

Easy Rain is not responsible for injury, escape of pets, interference, or delays caused by failure to secure pets, children, or occupants.

35. Cleanup

Easy Rain will make reasonable efforts to clean the work area after completing installation or repair. However, exterior construction work may leave small debris, dust, metal shavings, screws, nails, sealant residue, packaging fragments, or other materials despite reasonable cleanup efforts.

Customer should use caution around the work area after completion and notify Easy Rain promptly if cleanup concerns are discovered.

36. Ownership of Materials

Materials delivered to the property remain the property of Easy Rain or its suppliers until paid for in full, to the extent permitted by law.

Customer agrees not to move, use, install, damage, sell, or interfere with materials delivered for the project without Easy Rain’s permission.

37. Mechanics Liens and Collection Rights

If customer fails to pay amounts owed, Easy Rain may exercise any legal rights available, including but not limited to collection efforts, interest, late fees, attorney fees, court costs, lien rights, or other remedies permitted by law.

Nothing in these Terms waives Easy Rain’s right to pursue payment for labor, materials, services, change orders, or other amounts owed.

38. Intellectual Property

All content on the Easy Rain website, including text, graphics, logos, photos, videos, service descriptions, blog posts, designs, branding, layout, icons, and other materials, is owned by Easy Rain or used with permission.

You may not copy, reproduce, modify, distribute, display, sell, or exploit Easy Rain content without written permission.

You may share public Easy Rain website links for personal, informational, or referral purposes, provided you do not misrepresent Easy Rain or use our content in a misleading way.

39. User Submissions

If you submit photos, videos, messages, reviews, project information, comments, or other content to Easy Rain, you represent that you have the right to submit that content and that it does not violate the rights of others.

You grant Easy Rain a non-exclusive, royalty-free, worldwide license to use submitted content for purposes related to providing services, preparing estimates, communicating with you, documenting projects, resolving disputes, improving operations, and marketing Easy Rain, subject to our Privacy Policy and applicable law.

40. Prohibited Conduct

You agree not to:

  • Submit false or misleading information
  • Request work for property you do not own or control without authorization
  • Harass, threaten, abuse, or mistreat Easy Rain employees, subcontractors, or representatives
  • Refuse safe access after approving work
  • Interfere with installation or inspection
  • Misuse Easy Rain intellectual property
  • Attempt to damage our website or systems
  • Use our services for unlawful purposes
  • Make fraudulent payment disputes
  • Publish false or defamatory statements
  • Impersonate another person or business

Easy Rain reserves the right to refuse service, cancel appointments, terminate projects, or pursue legal remedies if a customer engages in prohibited conduct.

41. Refusal of Service

Easy Rain reserves the right to refuse service, decline estimates, cancel appointments, withdraw proposals, or terminate work where permitted by law.

Reasons may include but are not limited to unsafe conditions, abusive behavior, nonpayment, misrepresentation, unreasonable demands, unavailable materials, work outside our expertise, excessive risk, access issues, legal restrictions, or inability to agree on scope or terms.

42. Dispute Resolution

If a dispute arises, customer agrees to first contact Easy Rain in good faith so we have an opportunity to review and attempt to resolve the issue.

Customer should provide written notice describing the concern, project address, relevant dates, photos if available, and the requested resolution.

Easy Rain will review reasonable complaints and may request an inspection, documentation, or additional information.

Nothing in this section prevents either party from pursuing available legal remedies where necessary.

43. Governing Law

These Terms and any dispute related to Easy Rain, our website, communications, estimates, services, or projects shall be governed by the laws of the State of Utah, without regard to conflict-of-law principles.

Venue for any legal action shall be in a court of competent jurisdiction in Utah, unless otherwise required by law.

44. Attorney Fees

To the fullest extent permitted by law, if Easy Rain is required to pursue collection, enforce these Terms, defend against claims, or pursue legal remedies related to unpaid amounts, customer agrees to pay Easy Rain’s reasonable attorney fees, court costs, collection costs, and related expenses if Easy Rain is the prevailing party or as otherwise permitted by law.

45. Indemnification

You agree to indemnify, defend, and hold harmless Easy Rain LLC, its owners, employees, contractors, subcontractors, representatives, agents, vendors, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses arising from your breach of these Terms, your misuse of our website, your misrepresentation, your failure to provide safe access, your failure to obtain required approvals, your failure to disclose known property conditions, or your violation of applicable law.

46. Force Majeure

Easy Rain is not responsible for delays, failure to perform, added costs, or inability to complete work caused by events beyond our reasonable control, including but not limited to weather, storms, snow, ice, fire, flood, labor shortages, supplier delays, material shortages, transportation issues, accidents, illness, power outages, government action, natural disasters, emergencies, war, civil unrest, or acts of God.

47. Electronic Records and Signatures

You agree that electronic records, electronic signatures, text approvals, email approvals, online form submissions, financing approvals, and other electronic communications may satisfy any requirement for written approval or signature, to the fullest extent permitted by law.

48. Updates to These Terms

Easy Rain may update these Terms from time to time. The updated version will be posted on our website with a revised “Last Updated” date.

Your continued use of our website, communication with Easy Rain, request for services, or approval of work after updated Terms are posted means you accept the updated Terms.

For active projects, the Terms in effect at the time of project approval generally apply unless otherwise agreed in writing.

49. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining portions will remain in full force and effect.
